When the rain broke, following a two-day downpour in = late April=20 2000, David Biesenthal climbed onto his tractor and began moving 70 = tonnes of=20 manure from a concrete pad near his paddocks to his front field where he = was=20 planting corn.

Biesenthal is an equine veterinarian with a small = beef=20 calf and cash-crop farm on the edge of Walkerton and it was manure from = his farm=20 that primarily contaminated that town=92s water supply, an inquiry into = the=20 Walkerton tragedy concluded,.

Seven of his neighbours died and = more than=20 2,000 became ill, some gravely, when a combination of human error, = neglect and=20 mechanical problems allowed untreated water tainted with E. coli = bacteria to be=20 pumped through the town system.

Biesenthal did everything by the = book,=20 everything he could and ought to have done but fate had other ideas. =

Six=20 years later, Biesenthal remains frustrated by what he believes was a = hasty and=20 incomplete examination of what happened and concerned that farmers and = rural=20 Ontario are paying the price for post Walkerton reforms to provincial = water=20 protection laws and regulations.

New provincial legislation has = put the=20 onus on farmers and rural Ontario to protect the water sources used by = towns and=20 urban communities. In some cases, farmers will face new and stringent=20 restrictions if their crops, fertilizing, pesticide use or normal = livestock=20 operations pose a potential risk to drinking water sources. =

=93If the=20 urban communities want pristine water, they=92re going to have to pay = the=20 agricultural community to make it pristine and they=92re going to have = to pay us=20 for the land we take out of production,=94 Biesenthal said. =

Walkerton was=20 a catalyst for change. =93Walkerton was a wakeup call for all of us, = including our=20 government, including other governments,=94 former Premier Mike Harris = said in=20 June 2001, while testifying before the inquiry his government called = into the=20 tragedy.

The Walkerton inquiry by Justice Dennis O=92Connor = found cracks,=20 flaws and deadly weaknesses in the province=92s drinking water system.=20

O=92Connor concluded responsibility for Walkerton didn=92t just = rest with=20 the two brothers who operated the town=92s water system, Stan and Frank = Koebel.=20 They admitted to drinking on the job, routine falsification of water = safety=20 tests and records.

When people began to get sick the brothers = tried to=20 cover up their role, and failed to report E. coli contamination to = public health=20 officials for days after learning about the cause of the illness from = private=20 lab results.

Both brothers were charged and one jailed for their = roles.=20 Neither one, it turned out, was qualified for the job he held.=20

Provincial inspectors failed the community by tolerating serious = problems at the plant that were repeatedly documented in 1991, 1995 and = 1998.=20

The Conservative government of the day drew fire for cutting = budgets for=20 water testing and inspections and subsequently introduced a Clean Water = Act=20 intended to toughen water plant inspections and enforcement of water = protection=20 regulations.

O=92Connor went further, however, and recommended a = =93mult-barrier=94 approach to water protection =96 that the province = should protect=20 water at its source, from the time it falls from the sky to the time it = comes=20 out of consumers=92 taps.

The current Liberal government has = implemented=20 measures introduced by the Conservatives and passed its own new = legislation and=20 regulations, including a source water protection law.

Bill 43 = imposes=20 broad land use restrictions on property that supplies source water for = municipal=20 drinking water systems, including new restrictions on the use of manure = and=20 chemicals.

Some farmers view this as expropriation without = compensation.=20 There also are new requirements to document farm practices, new fines = for=20 noncompliance and more paperwork and bureaucracy.

The potential=20 implications of the legislation have raised the hackles of farmers = across the=20 province.

=93We bump into these concerns all the time,=94 said = Paul Mistele,=20 an Elgin-area farmer and vice-president of the Ontario Federation of=20 Agriculture.

Mistele is optimistic discussions between the = province and=20 the agricultural community will resolve many concerns in the farming = community=20 but admits the road ahead will be bumpy.

For example, the = legislation=20 provides $7 million for a =93farm stewardship=94 fund but it=92s not = clear that money=20 will be used to compensate farmers for land that=92s taken out of = production.=20

=93Should it be $70 million? I had some guy say it should be $7 = billion=20 but I don=92t think that=92s going to happen.=94

=93You have to = make dollars=20 available for research to understand the movement of groundwater so = we=92re not=20 throwing dollars down a rathole,=94 he said.

Mistele believes = there needs=20 to be a partnership among farmers, the province, municipalities and = other=20 stakeholders to protect water.

That partnership hasn=92t yet = been defined.=20 Clearly there will be intrusions into farm practices and farm land and = one of=20 the most difficult challenges, he said, will be assessing the cost of = change and=20 who should pay for it.

=93When you get down to the fact that = you=92re going=20 to have to quit putting manure on these fields or you=92re going to have = to change=20 some of our practices with crop protection then that to me sounds like = we=92re=20 offering a service to society,=94 Mistele said.

=93And in that = case I think=20 there should be compensation . . . on that from a year to year basis.=94 =

Wells also pose a risk and funding concern. Should, for example, = there=20 be public funding to properly cap the thousands of abandoned wells in = rural=20 Ontario each of which is a potential risk, as a direct conduit between = surface=20 contamination and drinking water sources?

Will farmers be = required to=20 seal off wells found on their property, at a cost of $3,000 to $5,000 or = more=20 each?

=93I think that has to be looked at,=94 Mistele said. =

Who even=20 will be responsible for finding old wells?

There is no = comprehensive=20 provincial inventory of abandoned wells and no long-term plan or funding = to deal=20 with abandoned wells.

Mistele suggested compromise and good will = is=20 needed from both government and the farming community. =

Government has=20 become aware of agriculture now and the impact it has on source water = but=20 doesn=92t yet have a =93clear understanding=94 of the ramifications of = proposed=20 changes, Mistele said.

For example, a fundamental principal of = the new=20 legislation is a =93precautionary=94 approach to water protection. If = there=92s a=20 potential threat, that=92s as good as a real threat.

The problem = of course=20 is how you define threat and who=92s doing the defining?

=93I = think we have=20 to take a risk-based approach versus a precautionary approach and find = those=20 areas that are most at risk,=94 he said.

Expectations need to be = tempered=20 with practicality.

Another potential area of conflict revolves = around=20 water movement. Restrictions will be based not only on direct threats, = for=20 example the distance from farm fields to municipal well heads, but on = local=20 hydrology and how fast water migrates from fields to municipal intakes. = It=92s not=20 always clear cut.

It is a concern that has come home to roost = for=20 Biesenthal

=93They did some research on my farm this summer and = water=20 moves down into the water table faster than they thought it did,=94 he = said.=20

=93When they put dye four and a half kilometres away, it was in = my well in=20 two days,=94 he said. =93That=92s moving pretty fast.=94

During = the Walkerton=20 inquiry, it was assumed water in the area took a couple of years to = migrate.=20

=93The movement of water was never really appreciated in the = first part of=20 the Walkerton investigation,=94 Biesenthal said. =93For whatever reason, = the town=20 hired a sand hydrologist and he made the original discovery that he felt = it was=20 the overland route of manure that (caused the contamination).=94 =

To reach=20 the well blamed for contaminating the town well, water would have had to = travel=20 uphill from Biesenthal=92s paddocks.

=93I=92m not convinced this = is an exact=20 science yet, I=92m not sure they really know how things move = (underground).=94=20

Given the apparently porous nature of the land in the area, = several=20 farms could have contributed to the contamination of Walkerton=92s water = supply.=20

=93They did look at 20 other farms around here right adjacent on = town, but=20 they focused on two,=94 Biesenthal said, his and one other. =

=93So I should=20 have realized I was the target,=94 Biesenthal said.

Tests never = confirmed=20 exactly how the E. coli got into the town water or where it came from.=20

=93The only place they ever found the bacteria in the water, = post=20 Walkerton was at the other wells, coming out of an exhaust pipe,=94 he = said.=20

Biesenthal is not looking for absolution or to shift blame, but = for=20 answers. To this day, he believes, the whole picture of what happened at = Walkerton hasn=92t been drawn.

Farmers in general, meanwhile, = will be on=20 the firing line once the impact of the new legislation and regulations = hit,=20 Biesenthal believes.

=93That=92s one thing I have been trying to = tell=20 farmers, for goodness sake, be prepared,=94 he said. =93Keep records of = everything.=20

=93We=92re being targeted with all of these acts and laws when I = honestly=20 believe 99 per cent of farmers are environmentally sound.=94 =

=93They=92d do=20 everything they could to protect the waterways,=94 he said. =93That=92s = what=20 frustrates me so much.=94
