The City of Kingston recently spent $115 million = upgrading its=20 Ravensview Water Pollution Control Plant.

It was the largest = single=20 capital project ever undertaken by the city and though the new facility = is state=20 of the art, like many others in communities across Ontario, it will pump = water=20 through ancient arteries.

Utilities Kingston President and CEO = Jim Keech=20 estimates a third of all treated water from both plants leaks and = disappears=20 into the ground before it gets to consumer taps.

=93That=92s not = the exact=20 number but I would say about 30 per cent,=94 Keech told Osprey News. = Keech=20 appreciates the irony that Kingston, like many other Ontario = communities,=20 preaches residential conservation and even restricts lawn watering from = June=20 through September while a third of its water dribbles through cracks in = the=20 system.

As part of a broader 10-year capital plan, Utilities = Kingston is=20 spending $10,000 to survey about a third of the city to see what can and = needs=20 to be done about the network of underground pipes.

However, = without=20 dedicated funds from senior levels of government, or dramatically higher = user=20 fees, the city will have to continue dealing with pipe replacement on a = measured=20 basis, which means fixing breaks caused by age or weather conditions and = gradually replacing the oldest pipes.

A third to half of all = Ontario=92s=20 clean, treated drinking water leaks into the ground before it ever gets = to=20 people=92s taps. Estimates on the work needed to upgrade the = province=92s network of=20 underground water pipes range from $11 billion to $18 billion, figures = that are=20 growing because of decades of government neglect.

Not that = things have=20 to be this way. Kingston=92s approach, the model the city uses to run = its=20 utilities, so impressed members of a provincially-appointed panel struck = to=20 study Ontario=92s water infrastructure problems they suggested other=20 municipalities consider adopting the city=92s utility structure. =

But such=20 diligence comes with a price. While the provincial government is in the = process=20 of making it mandatory for water systems to fully recover costs from = consumers=20 through water bills, Kingston has been doing just that since the late = 1990s.=20

As a consequence to moving to a stricter user-pay system, water = bills in=20 the city have increased substantially.

=93In some areas, we=92ve = had rate=20 increases of 70 per cent over a five-year-period,=94 Keech said. =

Kingston,=20 like every other municipality in the province, also has been required to = conform=20 to a number of new laws, inspections and regulations governing water and = sewage=20 since Walkerton, which have significantly increased the cost of water. = These=20 have not necessarily led to safer water.

Kingston has spent = another $10=20 million post Walkerton, not specifically to address =93significant=94 = water quality=20 issues but to ensure Kingston=92s two water treatment plants conform to = new=20 regulations.

=93Our inspection reports went from a couple of = pages to a=20 book of 100 pages,=94 Keech said citing one example.

=93A lot of = the=20 regulations they are bringing out are just paperwork and paper = shuffling. It=92s=20 expensive and at end of the day it=92s of absolutely no benefit to the = customer.=94=20

Kingston is not alone in this view. Several municipalities = contacted by=20 Osprey News expressed concern over the cost and effectiveness of post = Walkerton=20 regulatory change.

When the province tightened up water plant=20 inspections in 2003, the environment ministry hired dozens of new = inspectors to=20 carry out the work since it was impossible to find the numbers of = experience=20 engineers needed.

So instead, the ministry hired young people as = qualified as possible and trained them.

Municipal officials say = that the=20 combination of inexperience and post Walkerton zealotry, both in the = ministry=20 and by its inspectors, led to expensive and at times needless work. =

=93The=20 intent of the regulations was pushed so far that it caused a lot of = grief for=20 the municipalities,=94 said Abdul Khan, director of water and wastewater = treatment=20 with Hamilton=92s Public Works Department

Green inspectors = insisted on=20 adherence to the letter of new regulations, even when they didn=92t = understand the=20 implications of what that meant.

After three or four years of=20 inspections and turnover, the initial =93frenzy=94 has slowed down and = inspectors=20 now are experienced.

However, what happened flew in the face of = Justice=20 O=92Connor=92s recommendations from the Walkerton inquiry =96 both on = inspector=20 training and against taking a bureaucratic, regulatory approach to = dealing with=20 water treatment.

Dr. Steve Hrudy was an expert member on = O=92Connor=92s=20 commission. He told Osprey News the regulatory approach Ontario is = taking flies=20 in the face of O=92Connor=92s central recommendations. =

=93There=92s more=20 emphasis on penalties and ability to enforce them perhaps than there = needs to be=20 in ensuring good practice,=94 he said.

While many of = O=92Connor=92s=20 recommendations have been acted upon, the spirit of the report has been=20 misconstrued.

Instead of creating a better system, the emphasis = has been=20 on creating a costly new bureaucracy.

=93A careful reading of = the inquiry=20 report did set a context and some priorities in terms of what the = overall=20 direction should be and the emphasis was on putting in place systems = that ensure=20 competence,=94 Hrudy said.

=93It seems to me the things that = happened first=20 were the lawyers drafting regulations that simply specified specific = criteria=20 and penalties,=94 Hrudy said.

=93I=92m certainly disappointed in = that,=94 he=20 said. The pursuit of bureaucracy and regulatory zero-tolerance over = quality=20 management poses a risk that Ontario will pour billions of dollars into = an=20 unsustainable water and sewage system. Worse, smaller communities may be = susceptible to the kind of human error that led to Walkerton. =

=93A=20 regulatory program without adequate support and means for providing = capacity is=20 not going to be successful,=94 Hrudy said.

=93To simply regulate = without=20 putting in place the appropriate means of support and facilitating the = ways that=20 smaller communities can deal with the problem is not helpful.=94 =

Harry=20 Swain, who headed up the Watertight advisory panel, said Ontario is not = looking=20 at alternatives =96 innovative or less expensive ways to provide water = and sewage=20 service or even to extend the life of pipes.

=93Sometimes you = can line an=20 existing or worn-out pipe with a new vinyl or rubber line and get = another 20 or=20 30 years out of it,=94 Swain said.

David Caplan, Ontario=92s = minister of=20 public infrastructure renewal, is acutely aware of the need for more = money to=20 invest in water and sewer systems and the political will to get that = done.=20

Water and sewage infrastructure increasingly is =93under the = radar=94 both=20 in government and the public, Caplan said.

Watertight proposes = and=20 Caplan appears to support recommendations that will create large, = regional water=20 utilities across the province =96 merging multiple, small utilities = together that=20 will share costs and expertise.

It will require substantially = higher=20 water rates to pay for investment and, in some cases, may involve = participation=20 by the private sector in construction and financing of projects. =

The=20 reason that the province hasn=92t yet acted on Watertight is simply = because the=20 scale of need is so great it is taking time to figure out what to do, = Caplan=20 said.

=93If there is one thing that Justice O=92Connor was clear = about when=20 it came to ensuring that Ontarians have access to clean and safe = drinking water=20 it is that we need to completely review all of those aspects.=94 =

=93The=20 bottom line goal, what do we need to do to ensure safe clean water for = the=20 people of Ontario, that=92s what this is all about,=94 Caplan=20 said.
